General  

All goods sold are subject to these terms and conditions of sale provided by the “company100% Comfort Ltd (100% Comfort). No addition, alteration, variation or waiver of any of these conditions of sale shall be binding unless agreed in writing with the parties. The “customer” is any person or organisation to which the company shall provide or contract to provide goods. The customer shall be deemed to have agreed to these conditions in relation to any transaction between the two parties.     

No customer terms and conditions of purchase or other warranties, guarantees, standards, specifications and other matters whether written or oral, expressed or implied, shall form part or deemed to be incorporated into this contract unless agreed in writing by an authorised officer of each party.  

All other terms and conditions expressed or implied by statute or otherwise, are excluded to the fullest extent permitted by law.  

100% Comfort Ltd reserves the right to change the terms and conditions from time to time. The customer will be informed in writing of any such changes. 

Nothing in these terms and conditions shall affect the statutory rights of the consumer. 

Products (including Harrison Spinks Ltd) are only available for sale within the UK and currently exclude NI, Channel Islands and the Republic of Ireland. 

All products supplied by 100% Comfort Ltd (including Harrison Spinks Ltd) cannot be offered for sale on a third-party digital platform or marketplace not owned by the customer, without prior agreement in writing from the company. 

These conditions of sale shall be governed by and construed in accordance with English Law and each party agree to submit to the exclusive jurisdiction of the English courts. 

Orders  

The customer shall be responsible for ensuring the accuracy of all details provided when completing the order on the 100% Comfort Ltd website. 100% Comfort is not obliged to accept the order unless all details requested on the order form have been correctly completed.  

Placing Orders: the customer is to complete in full the customer order form on the 100% Comfort website. On receipt of your order, we will send an automated acknowledgement email confirming the status of the order. Your order will be delivered by one of our designated couriers. 

All items are subject to availability, we will inform you as soon as possible if the goods you have ordered are not available or delayed.  

No customer order shall be deemed accepted by 100% Comfort Ltd until we have confirmed acceptance of an order by e-mail.  

100% Comfort Ltd has the right to refuse to supply a customer without an obligation to provide a reason or cause however the customer will be notified by email in this instance. 

If an error is discovered in the price of the goods you have ordered, 100% Comfort Ltd will inform the customer as soon as possible. If the item and the price published on the site is incorrect for any reason, 100% Comfort Ltd will contact the customer to provide the correct price and ask if they still wish to proceed with the order at the correct price. 100% Comfort Ltd are under no obligation to fulfil an order for a product that was advertised at an incorrect price.  

Samples are chargeable with customers limited to one of each individual SKU. Samples can be ordered ahead of account set up by e-mailing hello@100comfort.com 

In terms of Harrisons products, other than initial samples, the minimum order quantity (MOQ) is one carton (5 pillows).    

 

Delivery  

The goods will be delivered to the customer at the address detailed on the order form input on the website. Any orders that are required to be delivered to an alternative address may incur an additional delivery fee.  

Delivery is limited to mainland United Kingdom only and currently excludes NI, Channel Islands the Republic of Ireland. With the Isle of Man & Isle of Wight and some remote areas of the Scottish Highlands and islands, lead times may be extended by up to 14 days and an additional delivery charge will be applied based on location. 

Orders on occasion may be despatched from multiple locations which may result in more than one delivery being made.   

Harrison Spinks Ltd goods are normally despatched within 1-2 weeks of receipt of order. If pallet quantities are required, this will be longer as all product is made to order.   

All other lead times will be subject to product availability and highlighted on individual product pages on the website. 

Charges  

Orders under £250 ex VAT will incur a delivery charge of £20. Orders over £250 ex VAT will be delivered free of charge.  

We aim to make delivery to your address within the time scales agreed, however we cannot be held responsible for any delay by our third-party couriers. 

Any delivery dates quoted are approximate only and 100% Comfort shall not be liable for any delay in delivery of the goods however caused. The customer shall have no right to cancel the order for failure of any cause to meet the delivery time stated. 

In the event that nobody is available to take delivery, notification will be left where practical. Please note that any orders that have to be re-delivered due to customer error may be subject to a re-delivery fee regardless of order value.  

On delivery the risk in the goods shall pass to the customer. 100% Comfort Ltd cannot be held liable for any parcels that are lost or stolen as a result of any specific delivery instructions left for the carrier. 

 

Payment 

The net price of the goods will be the price detailed on the order website and will be subject to VAT (UK). Any relevant delivery charges will be detailed separately. 

All payments are to be made through the website by Visa and/or Mastercard, unless otherwise agreed in writing. All payments have to be made at the point of order. Where an account has been approved been refer to separate terms and conditions provided.  

 

Description of Goods  

100% Comfort Ltd have taken all reasonable care to ensure that all details, descriptions and prices of products appearing on the website have been fairly represented and described. However, the illustrations are for representative purposes only and the product may differ slightly from the images shown. 

100% Comfort reserves the right to substitute products of a similar description and of at least the same quality if the requested goods are not available. In this unlikely event the customer will be entitled to a full refund within 14 days of receipt of the original order, should a substitute not be acceptable.  

The customer is not permitted to change, deface or obscure any identifying mark or packaging on the goods supplied without prior written consent from 100% Comfort Ltd. 

The customer must maintain the goods in a satisfactory condition and with Harrison’s products ensure the Harrison Spinks Ltd brand is protected.  

Refunds and Cancellations  

In the event that the goods supplied are incorrect or damaged in transit or delivery, it must be reported as soon after delivery as possible, within a maximum of 48 hours.  

It is the customers responsibility to check the goods on delivery to ensure they are free from fault, if a fault develops, we offer a replacement or refund within the first 30 days of delivery. All faults need to be reported to: hello@100comfort.com along with images and batch number. We reserve the right to have items returned prior to any refund or replacement. This does not affect your statutory rights.  

In the interests of hygiene, we are unable to offer a refund or exchange on a pillow once the inner bag and/or hygiene tag (if applicable) has been opened, unless the product is faulty. This does not affect your statutory rights. We strongly advise that the end consumer be made aware of this.   

Intellectual Property  

All copyright, trademarks and all other intellectual property rights in all material or content supplied or permitted for use shall remain at all times vested in us as licensors “100% Comfort Ltd”. 

Unique to Harrisons Spinks Ltd we have developed a range of high-quality images for use in connection with advertisement, promotion and sale of the Harrison Spinks product, the intellectual property rights, including trademarks remain the property of the Licensor.  

Customers are only permitted to use the images, trademarks and content with prior written consent.  

Limitation 

100% Comfort Ltd shall not in any event be liable for any loss of profit or other indirect or consequential loss or damage howsoever arising.  

Except as specifically provided in these terms and conditions, 100% Comfort shall be under no liability for any loss or damage whatsoever attributable to any act, default or failure to carry out the contract terms.  

If the ability of 100% Comfort to perform its obligations is limited, delayed or prevented in whole or part by any reason whatsoever not reasonably within the control of 100% Comfort Ltd, then the company shall be excused, discharged and released without penalty from performance of the contract to the extent that such performance is so limited, delayed or prevented.
